These Terms of Use, Privacy Policy, Refund Policy, Shipping Policy, User Responsibilities, Prohibited Conduct, Intellectual Property Policy, Disclaimer, Final Interpretation Rights, and any other agreements, policies, or notices published on the DragonNails website (collectively, the “Agreements”) are governed by and construed in accordance with the laws of the People’s Republic of China (excluding its conflict of laws principles), unless otherwise expressly stated in a specific agreement or required by mandatory provisions of law applicable to the consumer in their place of residence.

1. Applicable Law

  • The formation, performance, interpretation, validity, and any dispute arising out of or in connection with these Agreements shall be governed exclusively by the laws of the People’s Republic of China.
  • If you are a consumer located in a jurisdiction that provides mandatory consumer protection rights that cannot be waived by contract (e.g., certain provisions under the EU Consumer Rights Directive, UK Consumer Rights Act 2015, California Consumer Privacy Act/CPRA, or equivalent laws), those mandatory protections apply to you notwithstanding the choice of law above. However, to the maximum extent permitted by law, any non-mandatory aspects remain governed by PRC law.

2. Jurisdiction and Venue

  • Any dispute, controversy, or claim arising out of or relating to these Agreements, the website, any products or services provided by DragonNails, or the relationship between you and DragonNails (including non-contractual disputes or claims) shall be submitted to the exclusive jurisdiction of the people’s courts located in the place where DragonNails is domiciled (currently [insert your city/province, e.g., Shanghai Municipality / Guangdong Province / etc.]).
  • You hereby irrevocably submit to the personal and exclusive jurisdiction of those courts and waive any objection to venue or inconvenient forum.

3. Alternative Dispute Resolution (Optional / If Applicable)

  • We encourage informal resolution first. Before initiating any formal proceedings, please contact us at support@dragonnails.store with a detailed description of your concern. We will attempt to resolve the matter within a reasonable time.
  • If informal resolution fails and you are a consumer in a jurisdiction that requires or allows alternative dispute resolution (e.g., EU/EEA online dispute resolution platform), you may submit the dispute to the relevant platform where applicable. However, DragonNails is not obligated to participate in any alternative dispute resolution procedure unless required by mandatory local law.

4. Class Action / Collective Action Waiver

To the fullest extent permitted by applicable law, you agree that any disputes must be brought on an individual basis only and not as a plaintiff or class member in any purported class action, collective action, private attorney general action, or other representative proceeding.

5. Severability

If any provision of this Governing Law and Jurisdiction clause is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the invalid or unenforceable provision shall be reformed to the minimum extent necessary to make it valid and enforceable.

By accessing the website, placing an order, or otherwise interacting with DragonNails, you expressly consent to the governing law and exclusive jurisdiction set forth above.
