DragonNails is built on original designs, cultural reinterpretations of Chinese dragon mythology, handcrafted techniques, and a distinctive brand identity. Our intellectual property (IP) is the core of what makes every piece unique, powerful, and unreplicable. We take the protection of our IP very seriously.

This Intellectual Property Policy explains what is protected, how we expect others to respect it, and the consequences of infringement.

1. What We Own

DragonNails and its affiliates exclusively own or license all intellectual property rights in:

  • The brand name “DragonNails®” (registered or unregistered trademark)
  • Slogans including but not limited to: “Wear the Dragon. Become the Story.” “Carry the legend.” “Not Just Nails. Cultural Power You Can Wear.”
  • All logos, dragon motifs, symbolic elements (specific cloud patterns, armor textures, guardian expressions, dynasty-inspired detailing), color combinations, and artistic compositions used across collections (Urban Rebel Dragon, Imperial Gold Dragon, Temple & Myth Dragon, Masterpiece Edition)
  • Product photographs, styling images, website design & layout, video content, packaging graphics
  • Handcrafted techniques, layering processes, sculptural application methods, and proprietary finishing methods (considered trade secrets where applicable)
  • All text, copywriting, product descriptions, and marketing materials created by DragonNails
  • Any custom/bespoke designs produced for individual customers (the underlying artistic expression and technique remain our property even after sale)

2. Limited License Granted to Customers

When you purchase a DragonNails product (standard or custom):

  • You receive a limited, personal, non-exclusive, non-transferable, revocable license to:
    • Wear the physical product
    • Take personal photographs/videos of yourself wearing it for non-commercial social sharing
    • Gift the physical item to another individual (the license transfers with the product)

You are expressly prohibited from:

  • Reproducing, copying, scanning, 3D-scanning, photographing for commercial resale, or reverse-engineering any design
  • Manufacturing, commissioning, or selling duplicates, replicas, “inspired by”, or derivative versions (including modified customs)
  • Using our brand name, logos, motifs, or product images in any commercial context (e.g., your own store, dropshipping listings, affiliate marketing, sponsored posts without written permission)
  • Creating or operating any website, social account, or marketplace listing that uses “DragonNails”, similar-sounding names, or confusingly similar dragon artwork to sell competing or counterfeit products

3. Custom / Bespoke Orders

Even when a piece is fully customized for you:

  • The underlying artistic style, dragon expression vocabulary, symbolic language, sculptural techniques, and brand DNA remain DragonNails intellectual property.
  • You may not share the final design files (if provided), commission the same or substantially similar design from another maker, or resell the custom piece commercially.

4. Reporting Infringement

If you believe someone is infringing DragonNails intellectual property (counterfeit listings, stolen photos, unauthorized use of our brand name/motifs, replica sellers, etc.), please report it promptly to:

Please include:

  • URL/link to the infringing content
  • Screenshots (if the page might be removed)
  • Explanation of how it infringes (e.g., exact copy of our dragon motif, using our slogan in a competing store)

We investigate all credible reports and take swift action, including DMCA takedowns, platform reports (Etsy, Amazon, Taobao, Shopee, etc.), cease-and-desist letters, and legal proceedings when necessary.

5. Our Enforcement Rights

We reserve the right to:

  • Immediately terminate any customer account involved in IP misuse
  • Cancel and retain payment for any order suspected of being placed for counterfeiting/resale purposes
  • Pursue civil and/or criminal remedies (including damages, injunctions, and attorney fees) against infringers
  • Cooperate with law enforcement and intellectual property offices worldwide

We do not issue warnings in clear cases of commercial-scale counterfeiting, pattern infringement, or bad-faith brand impersonation.

6. Respect the Craft

Every DragonNails piece represents hundreds of hours of skilled handwork, cultural research, and artistic vision. Imitation does not honor the dragon — it dishonors the artisans and the women who choose to wear real stories instead of copies.

By using our website, purchasing our products, or interacting with DragonNails, you agree to respect and protect our intellectual property in the same way we protect the legend we invite you to carry.
